Terms of Service

These Terms of Service (the "Terms") are an agreement between you and the provider of the Byfind app named at the end of this page ("Byfind", "we", "us"). They apply to the Byfind iOS app and the services it uses (together, the "Service"). By installing or using the Service you accept these Terms. If you do not agree, do not use the Service.
The Service
Byfind lets you photograph things around you, isolates the subject of the photo, generates a short introduction to it and saves the result to a personal collection on your device. Collections are stored on your device; the Service does not provide an account, cloud sync or backup of your collection. If you delete the app, your collection is deleted with it unless you have backed up your device yourself.
Some features are only available with an active Plus subscription. The features included in the free version and in Plus are shown in the app and may change over time.
AI-generated descriptions
Descriptions of the subjects you photograph are generated automatically from the image, using online analysis services. They are produced without human review and may be incomplete, out of date or wrong. The identification of a subject is an estimate, and the app may not be able to identify a subject at all.
Descriptions are provided for general interest and education only. They are not professional, medical, safety, legal or financial advice. Do not rely on them to decide whether a plant, mushroom, animal, food, drink or medicine is safe to eat, touch or use, to determine the authenticity, origin or value of an object, or for any decision where a mistake could cause harm or loss. Always verify important information with a qualified source.
Your content
You keep all rights to the photos you take or choose. So that we can provide the Service, you grant us a non-exclusive, worldwide, royalty-free licence to receive, store, process and transmit your photos and the generated descriptions for the purpose of operating, securing and improving the Service. This licence ends when the data is deleted as described in the Privacy Policy.
You are responsible for the content you submit. Only submit photos you have the right to use. Do not submit photos that are illegal, that infringe the rights of others, or that contain other people's personal information without a lawful basis.
You may use the generated descriptions for personal, non-commercial purposes within the app. Similar or identical descriptions may be generated for other users, and we do not guarantee that a description is original or free of third-party rights.
Acceptable use
You must not:
- use the Service for any unlawful purpose or in a way that harms others;
- attempt to reverse engineer, copy, resell or interfere with the Service, its analysis services or its request signing;
- send automated or excessive requests, probe the Service for weaknesses or circumvent usage limits;
- use the Service to generate content that is abusive, misleading or intended to deceive.
We may limit, suspend or terminate access to the Service for use that violates these Terms.
Subscriptions and purchases
Plus is an auto-renewing subscription sold through the Apple App Store. Prices, billing periods and any free trial are shown in the app before you buy. Payment is charged to your Apple ID account when you confirm the purchase. The subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the period ends. You can manage or cancel the subscription in your Apple ID settings. Refunds are handled by Apple under its terms.
Purchases can be restored on a device signed in to the same Apple ID. We do not sell subscriptions outside the App Store and do not receive your payment details.
Availability and changes to the Service
The Service depends on your device, network and third-party services. We do not guarantee that analysis will always be available, fast or free of errors, and we may change, suspend or discontinue features at any time. Where we discontinue a paid feature, your rights under Apple's refund rules and applicable consumer law are not affected.
Liability
The Service is provided "as is" without warranties of any kind, to the extent permitted by law. To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential loss, for loss of data on your device, or for damage arising from reliance on a generated description. Nothing in these Terms limits liability that cannot be limited under applicable law, or reduces the rights you have as a consumer under the law of the country where you live.
Apple
The app is distributed through the Apple App Store. Apple is not a party to these Terms and is not responsible for the Service, its content or any support. Apple's Standard End User Licence Agreement applies in addition to these Terms; where the two conflict, these Terms apply to the extent permitted.
Changes to these Terms
We may update these Terms when the Service or the law changes. The date at the top of this page shows when they were last updated. Material changes are announced in the app or on this page before they take effect. Continuing to use the Service after a change means you accept the updated Terms.
Governing law
These Terms are governed by the law of the place where the service provider named below is established, without affecting mandatory consumer protection rules that apply where you live. If any part of these Terms is found invalid, the rest remains in effect.
